Q & A
Do I need a lawyer?
If you’ve been issued a warrant/subpoena to appear before a grand jury; if you have been charged with a criminal case; if any member of law enforcement has called or visited you at your home, office, or any other location, you need a lawyer to ensure that your rights are protected every step of the way.
Is my case federal or state?
If the law enforcement agency contacting you is local (Chicago Police Department, Illinois State Police, etc), you have a state case. If you have been contacted by a federal agency (FBI, etc), your case is federal.
Should I agree to be interviewed by law enforcement agents or prosecutors without an attorney present?
NO. You have a right to remain silent. Without an attorney present, you should exercise this right. Anything you say may be used against you. Even if you believe you have done nothing wrong, you should exercise your rights to remain silent and to speak with a lawyer before agreeing to be interviewed by any law enforcement agent or prosecutor.
